Welcome to Zen Kitchens. By accessing and using our website and services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before proceeding.
2. Definitions
- "Company", "we", "our", and "us" refers to Zen Kitchens
- "Customer", "you", and "your" refers to the person or entity accessing our website or purchasing our products
- "Products" refers to any cabinets, countertops, or related items available for purchase
- "Services" refers to design consultations, installations, and other offerings
3. Ordering and Payment
This section outlines the terms and conditions related to ordering products from Zen Kitchens and payment procedures. By placing an order with us, you agree to be bound by these terms.
3.1 Order Process
3.1.1 Order Acceptance:
- All orders placed through our website, phone, or other designated channels are considered an offer to purchase products from Zen Kitchens.
- Order acceptance is at our sole discretion. We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Product unavailability or stock limitations.
- Errors in product information or pricing.
- Suspicion of fraudulent activity or unauthorized transactions.
- Shipping restrictions to your location.
- Customer conduct or order history concerns.
- If we refuse your order, we will attempt to notify you using the contact information provided with the order and will refund any payment already processed for that order.
3.1.2 Order Confirmation:
- Upon placing an order, you will receive an order confirmation email to the email address you provided. This email confirms that we have received your order and provides an order reference number.
- Please note: This order confirmation email does not constitute acceptance of your order. Order acceptance occurs only after we have received the downpayment for your order.
- It is your responsibility to review the order confirmation email and notify us immediately of any discrepancies or errors.
3.1.3 Order Modifications and Cancellations:
- You may request to cancel your order before it has been processed for shipping. Cancellation requests should be submitted to info@zenkitchensrta.com or (866) 936-6965 with your order number clearly stated.
- If your cancellation request is received and processed before shipment, we will issue a full refund of the purchase price, typically within 3-7 business days.
- Once an order has been shipped, it cannot be cancelled. In such cases, our return policy will apply.
- For assembled, custom or made-to-order items, cancellation may not be possible or may be subject to cancellation fees, especially if production has already commenced. Details regarding cancellation policies for custom orders will be provided at the time of order placement.
3.1.4 Product Availability:
- All product listings are subject to availability. We strive to maintain accurate inventory information on our website, but errors can occur.
- If a product you ordered becomes unavailable after your order is placed but before shipment, we will notify you as soon as possible.
- You will have the option to:
- Wait for Restock (if applicable): If the product is expected to be restocked, we will provide an estimated restock date and you can choose to wait.
- Select a Substitute Product (if available): We may offer a comparable substitute product.
- Cancel the Item and Receive a Refund: You can choose to cancel the unavailable item and receive a refund for that portion of your order. If the unavailable item is essential to the order, you may choose to cancel the entire order for a full refund.
3.2 Payment Terms
3.2.1 Payment Requirements:
- For all orders, a payment commitment is required to initiate order processing. The specific payment structure depends on the order value and product type, as outlined below.
3.2.2 Full Payment or Down Payment Options:
- Orders Below $3,999: Payment is required in full at the time of ordering, as described in section 3.2.3.
- Orders of $3,999 or Greater: Customers have the option to pay either:
- Payment in Full: Pay the entire order value at the time of ordering.
- Down Payment and Balance Payment: Pay a down payment of half (50%) of the total order value at the time of ordering, with the remaining balance due prior to order shipment, as detailed in section 3.2.4 and 3.2.5.
- Assembled, Custom or Made-to-Order Items: A down payment of half (50%) of the total order value is required at the time of ordering for all assembled, custom or made-to-order items, regardless of the total order value. The remaining balance is due prior to order shipment, as detailed in section 3.2.4 and 3.2.5. Specific down payment requirements for custom orders will be confirmed during the order quoting and confirmation process.
3.2.3 Full Payment at Time of Order (for Orders Below Threshold or Full Payment Option):
- For orders where full payment is required or chosen at the time of ordering, the total order value, including product costs, shipping and handling charges, sales tax (if applicable), and any other fees, is due and payable immediately upon order placement.
- We will not process your order until full payment has been received and verified.
3.2.4 Down Payment at Time of Order (for Orders Above Threshold or Custom Orders):
- For orders where a down payment option is available or required, a down payment equal to half (50%) of the total order value is due and payable at the time of order placement.
- The down payment secures your order, initiates order processing, and reserves product inventory.
- Order processing, including design services, order fulfillment, and production (for custom items), will commence upon receipt and verification of the down payment.
3.2.5 Balance Payment (for Orders with Down Payment):
- For orders where a down payment has been made, the remaining balance, which is half (50%) of the total order value, plus any outstanding charges, is due prior to order shipment.
- Notification of Balance Due: We will notify you when your order is nearing completion and ready for shipment, or when it is ready for pickup (if applicable). This notification will include the exact balance due and instructions for payment.
- Payment Deadline: The balance payment must be received within 7 calendar days of the balance due notification date. Failure to remit the balance payment within this timeframe may result in order delays, storage fees, or order cancellation (see section 3.2.6).
- Accepted Balance Payment Methods: Balance payments can be made using the same payment methods accepted for full payment and down payments (see section 3.2.7).
3.2.6 Order Cancellation Due to Non-Payment of Balance:
- If the balance payment for an order with a down payment is not received within 14 calendar days of the initial balance due notification date, Zen Kitchens reserves the right to cancel the order.
- Down Payment Forfeiture upon Cancellation: In the event of order cancellation due to non-payment of the balance by the customer, the down payment of half (50%) of the order value is non-refundable and will be forfeited. This down payment covers costs associated with order processing, inventory reservation, design services, and potential production initiated based on the order.
- Prior to order cancellation due to non-payment, we will make reasonable attempts to contact you to remind you of the outstanding balance and payment deadline.
3.2.7 Accepted Payment Methods:
- Major Credit Cards (Visa, MasterCard, American Express, Discover): We accept major credit card payments for your convenience. Please note that a transaction fee of 3.75% will be applied to all credit card payments. This fee helps to offset the processing costs associated with credit card transactions. The transaction fee will be clearly displayed during the checkout process before you finalize your payment.
- Debit Cards: (Bearing Visa or MasterCard logo) Debit card payments are generally processed without transaction fees.
- Bank Transfers/Wire Transfers: Bank transfers or wire transfers are accepted, especially for larger orders, and typically do not incur transaction fees from Zen Kitchens. Please contact our sales team at info@zenkitchensrta.com or (866) 936-6965 for bank transfer details and to confirm if any fees apply. Your bank may still charge fees for wire transfers.
- Financing Options: We offer financing through Affirm and select Credit Unions. Financing options may be applicable to the full order value or the balance payment, depending on the financing provider's terms. Please confirm financing applicability with our sales team and the financing provider. Financing terms and fees are determined by the financing provider and are separate from Zen Kitchens' payment terms and any credit card transaction fees.
Sections 3.2.8 through 3.2.12 remain as previously defined in the "3.2 Payment Terms" section.
3.2.13 Payment Fees Transparency:
- We are committed to transparency regarding payment fees. Any applicable transaction fees, such as the 3.75% credit card processing fee, will be clearly disclosed to you during the checkout process, before you are required to confirm and submit your payment.
- By choosing to pay with a major credit card, you acknowledge and agree to the application of this transaction fee.
- We encourage you to review all payment options and associated fees before making your payment selection.
By proceeding with an order and selecting a payment method, you acknowledge that you have read, understood, and agree to these Ordering and Payment terms and conditions, including the transaction fee for major credit card payments.
4. Shipping and Delivery
This section outlines the terms and conditions related to the shipping and delivery of products purchased from Zen Kitchens.
4.1 Delivery Area and Options:
- Service Area: We currently offer delivery services within New York Metro Area (Southern NY, Northern NJ, Southeastern Connecticut, and Eastern Pennsylvania). Specific delivery availability and timeframes may vary depending on your exact location within this region. Please confirm delivery availability to your address with our sales team prior to placing your order.
- Standard Delivery: Standard delivery service is available to most locations within our service area. This typically includes curbside delivery to the address provided. Inside delivery, installation, or assembly services are generally not included in standard delivery unless explicitly stated otherwise in your order confirmation.
- Delivery Timeframes: Delivery timeframes are estimates only and commence from the date of shipment, not from the date of order placement.
- Estimated delivery timeframes will be provided by our team based on your delivery address, product availability, and current shipping schedules.
- These timeframes are estimates and are not guaranteed. Actual delivery dates may vary.
- We will make reasonable efforts to meet estimated delivery timeframes, but we are not responsible for delays that are outside of our direct control, including but not limited to:
- Shipping carrier delays (weather, mechanical issues, logistical disruptions, etc.).
- Manufacturing delays (for out-of-stock or custom items).
- Delays due to incomplete or inaccurate delivery information provided by the customer.
- Force majeure events (natural disasters, pandemics, etc.).
- Delivery Scheduling: Once your order is ready for shipment, our shipping team or a third-party carrier will contact you to schedule a delivery appointment window. We will attempt to accommodate reasonable scheduling requests, but delivery dates and times are subject to carrier availability and routing.
- Customer Responsibility for Receiving Delivery: It is your responsibility to ensure that someone is available at the delivery address during the scheduled delivery window to receive and inspect the order. If no one is available to receive the delivery, or if the delivery address is inaccessible or unsafe for delivery personnel, redelivery charges may apply (see section 4.4).
4.2 Special Delivery Requirements and Charges:
- Inside Delivery: Requests for delivery personnel to bring items inside your home or building beyond the entryway or threshold.
- Upstairs/Multi-Story Delivery: Delivery to locations above the ground floor or requiring elevator access.
- Specific Delivery Time Requests: Requests for delivery outside of standard delivery windows or requiring highly specific delivery times.
- Remote or Difficult-to-Access Locations: Deliveries to locations with limited access, narrow roads, gated communities, islands, or areas requiring ferry or toll road access.
- Liftgate Service: If your delivery location does not have a loading dock and requires a liftgate to lower heavy items from the delivery truck to ground level.
- Storage Fees: If you are unable to accept delivery within a reasonable timeframe after your order is ready for shipment, storage fees may apply.
4.3 Free Shipping Promotion:
- Free Shipping on Orders Over $3,999: We offer free standard shipping on orders with a total product value exceeding $3,999 (excluding taxes and any applicable special delivery charges).
- Eligibility: Free shipping applies only to standard delivery within our standard service area. Special delivery charges (as outlined in section 4.2) may still apply to orders qualifying for free shipping if special services are required or requested.
- Promotion Subject to Change: Zen Kitchens reserves the right to modify or terminate the free shipping promotion at any time without prior notice.
4.4 RTA Cabinet and Countertop Order Fulfillment:
- RTA Cabinet Orders (Without Countertops): Orders for Ready-to-Assemble (RTA) cabinets only (excluding quartz countertops) are typically fulfilled and ready for shipment within one (1) business day of order confirmation and payment processing, subject to product availability.
- RTA Cabinet Orders (With Quartz Countertops): If your order includes quartz countertops, the fulfillment timeframe will be extended due to the countertop fabrication process.
- Countertop Fabrication Time: Quartz countertop fabrication typically requires 7-14 business days from the date of final countertop measurements and template approval. This timeframe is an estimate and may vary depending on fabrication complexity, current workload, and material availability.
- Combined Shipment: RTA cabinets and countertops will generally be shipped together once countertop fabrication is complete. The overall order fulfillment timeframe will be determined by the countertop fabrication lead time.
- Our team will provide you with an estimated timeframe for countertop fabrication and overall order shipment when you place your order.
4.5 Risk of Loss and Title:
- Risk of Loss: The risk of loss and damage to products passes to you upon our delivery of the products to the shipping carrier or upon making the products available for pickup at our designated location (if applicable).
- Title Transfer: Title to the products passes to you upon our delivery of the products to the shipping carrier or upon making the products available for pickup at our designated location (if applicable), provided that we have received full payment for the order.
4.6 Inspection Upon Delivery:
- Inspect for Damage: Upon delivery, it is crucial that you thoroughly inspect all packages and products for any visible signs of damage before signing the delivery receipt.
- Note Any Damage on Delivery Receipt: If you notice any damage to packaging or products upon delivery, clearly note the damage on the delivery receipt before signing it. Take photographs of any visible damage to packaging and products as evidence.
- Report Damage Immediately: Report any shipping damage to Zen Kitchens customer service within 24 hours of delivery, even if damage was noted on the delivery receipt. Provide your order number, details of the damage, and any supporting photographs.
- Failure to Inspect and Report: Failure to properly inspect your order at the time of delivery and note any damage on the delivery receipt and report it to us within the specified timeframe may limit our ability to process damage claims with the shipping carrier and may affect your eligibility for replacement or refund for damaged items.
4.7 Redelivery and Storage Fees:
- Redelivery Fees: If delivery is attempted and unsuccessful due to reasons within your control (e.g., no one available to receive delivery, incorrect delivery address, inaccessible delivery location, refusal to accept delivery without valid reason), you may be responsible for redelivery fees. The amount of redelivery fees will vary depending on the carrier and delivery location.
- Storage Fees: If you are unable to accept delivery within a reasonable timeframe after your order is ready for shipment and we agree to hold your order in our warehouse or a third-party storage facility, storage fees may apply. Storage fees will be assessed based on the storage duration and space occupied by your order.
- We will notify you of any applicable redelivery or storage fees before they are incurred, whenever reasonably possible.
By placing an order, you acknowledge that you have read, understood, and agree to these Shipping and Delivery terms and conditions.
5. Returns and Refunds
At Zen Kitchens, we strive for your complete satisfaction with every purchase. We understand that sometimes returns are necessary. Our return policy is designed to be fair and transparent, allowing for returns within 14 days of delivery, subject to the following conditions and procedures:
5.1 14-Day Return Window:
- You may initiate a return request for eligible products within 14 calendar days from the date of delivery of your order.
- The delivery date is determined by the shipping carrier's tracking information.
- Return requests made after the 14-day period will generally not be accepted, except in cases of documented shipping damage or product defects reported within the specified timeframe (see section 4.6 and 5.5).
5.2 Conditions for Acceptable Returns:
To be eligible for a return and refund, returned products must meet the following conditions:
- Unused and Unassembled: Products must be in new, unused, and unassembled condition. They must not have been installed, modified, or used in any way. This includes, but is not limited to:
- Cabinets: Must not be assembled, installed, or have any hardware attached.
- Countertops: Must not be installed, cut, or altered in any way.
- Vanities: Must not be assembled, installed, or have plumbing fixtures attached.
- Hardware: Must not be installed or used.
- Original Packaging: Products must be returned in their original packaging, including all original boxes, cartons, protective materials, manuals, and accessories. The packaging must be in resalable condition, meaning it is not excessively damaged, torn, or defaced. If original packaging is missing or significantly damaged, the return may be refused or subject to a restocking fee (see section 5.4).
- Complete and Resalable: All components, parts, and accessories originally included with the product must be returned. The product must be in a condition suitable for resale as new.
- Not Damaged by Customer: The product must not be damaged due to customer misuse, negligence, improper handling, or during the return shipping process (damage during return shipping is the customer's responsibility - see section 5.3).
5.3 Non-Returnable Items:
The following items are non-returnable and are not eligible for refunds, except in cases of documented shipping damage or manufacturing defects reported within the specified timeframe:
- Custom Orders: Products that are custom-made, made-to-order, or specifically configured to your specifications are non-returnable. This includes, but is not limited to:
- Custom-sized or custom-finished cabinets.
- Custom-fabricated countertops (quartz or other materials).
- Any product that has been altered or modified at the customer's request.
- Reason for Non-Returnable Custom Orders: These items are created specifically for your order and cannot be resold to other customers.
- Clearance Items: Products sold as "clearance," "closeout," "liquidation," or "final sale" are non-returnable.
- Installed or Assembled Items: Once products have been installed or assembled, they are no longer eligible for return, except for valid warranty claims (see section 6).
- Samples: Samples of materials, finishes, or colors are non-returnable.
5.4 Return Shipping Costs and Restocking Fees:
- Customer Responsibility for Return Shipping: Unless the return is due to a documented error on our part (e.g., wrong item shipped, shipping damage), you are responsible for all return shipping costs. This includes packaging, shipping fees, and insurance for the return shipment.
- Return Shipping Arrangements: You are responsible for arranging and paying for return shipping using a reputable shipping carrier. We recommend using a trackable and insured shipping method to ensure safe and documented return delivery.
- Restocking Fees (May Apply): In certain circumstances, a restocking fee may be applied to returns. Restocking fees, if applicable, will be deducted from your refund amount. Restocking fees may be applied in the following situations:
- Damaged or Missing Packaging: If the original product packaging is missing, significantly damaged, or renders the product unsalable as new, a restocking fee of 20% of the product purchase price may be applied to cover repackaging and diminished value.
- Returns of Large Quantities: For returns of unusually large quantities of standard stock items, a restocking fee of 15% may be applied.
- Restocking fees, if applicable, will be communicated to you during the return authorization process.
5.5 Damaged or Defective Items:
- If you receive products that are damaged in shipping or are defective upon arrival, please refer to section 4.6 "Inspection Upon Delivery" regarding reporting shipping damage.
- For manufacturing defects discovered after delivery but within the warranty period, please refer to our Warranty Policy in section 6 for warranty claim procedures.
- This Return Policy applies to standard returns for reasons other than initial shipping damage or manufacturing defects.
5.6 Refund Process:
- Return Authorization Required: You must obtain a Return Authorization (RA) number from Zen Kitchens before returning any products. Returns sent without a valid RA number may be refused and returned to sender at your expense.
- Initiating a Return Request: To initiate a return request, please contact our customer service team at info@zenkitchensrta.com or (866) 936-6965 within the 14-day return window. Provide your order number, the product(s) you wish to return, and the reason for the return.
- Return Instructions: Once your return request is approved and an RA number is issued, we will provide you with detailed return shipping instructions, including the return shipping address and any specific packaging requirements.
- Inspection of Returned Items: Upon receiving your returned items, we will inspect them to ensure they meet the conditions for acceptable returns outlined in section 5.2.
- Refund Issuance: If the returned items are approved after inspection, we will process your refund within 14 business days of receiving the returned items.
- Refund Method: Refunds will be issued in the original form of payment used for the purchase. For credit card payments, refunds will be credited back to the original credit card used for the purchase. For other payment methods, refunds will be processed accordingly.
- Deductions from Refund: Your refund amount will be for the original purchase price of the returned items, less any applicable return shipping costs, restocking fees (if applicable), and original shipping charges (unless the return is due to our error). Original shipping charges are generally non-refundable unless we made an error in shipping.
5.7 Exceptions and Discretion:
- Zen Kitchens reserves the right to make exceptions to this Return Policy on a case-by-case basis, at our sole discretion.
- We also reserve the right to refuse any return if the returned products do not meet the conditions outlined in this policy, or if we suspect abuse or fraudulent return activity.
6. Warranty
Limited Lifetime Warranty
Zen Kitchens ("we," "us," or "our") provides the following Limited Lifetime Warranty to the original purchaser of all cabinetry, vanities, and hardware manufactured by or for Zen Kitchens. This Limited Lifetime Warranty ("Warranty") is extended to the original purchaser of cabinetry, vanities, and hardware ("Products") for use in residential applications within NY, NJ, CT, and PA. Except as allowed by applicable law, you may not assign or transfer this Warranty.
6.1 Original Purchaser Definition:
For the purposes of this Warranty, an "original purchaser" is defined as:
- Residential Homeowner: An individual who purchases and installs the Products in a dwelling that is owned and used by that person as a primary or secondary residence. This excludes rental properties, landlords, leasing companies, and other commercial purchasers acting as property managers or owners of rental units.
- Builders, Contractors, and Developers: A business or person such as a builder, contractor, or developer that purchases and installs Zen Kitchens Products in a newly constructed or renovated dwelling that will be used by the initial owner/purchaser of that dwelling as a primary or secondary home.
This Warranty does not extend to commercial purchasers, landlords, leasing companies, or properties used primarily for rental income generation.
6.2 Warranty Coverage:
Subject to the limitations and exclusions set forth in this Warranty, Zen Kitchens warrants to the original purchaser that the Products will be free from defects in material and workmanship under normal residential use for as long as the original purchaser owns the Products and resides in the home where the Products were originally installed.
- Defects in Materials: Defects in the materials used in the manufacturing of the Products that affect their structural integrity and functionality under normal use.
- Defects in Workmanship: Defects in the assembly and manufacturing process that affect the structural integrity and functionality of the Products under normal use.
- Normal Wear and Tear: Damage that occurs due to normal wear and tear, aging, and routine use over time, including but not limited to minor scratches, dents, chips, and changes in color or finish over time.
- Misuse, Abuse, and Alterations: Products that have been misused, abused, neglected, improperly handled, or subjected to unauthorized alterations or modifications.
- Improper Installation, Storage, or Environmental Conditions: Products that have been improperly installed, stored, or placed in humid environments, subjected to improper temperatures, or exposed to excessive moisture or extreme temperature fluctuations.
- Damage from External Factors: Damage caused by flood, fire, smoke, earthquake, storms, other natural disasters, accidents, or acts of God.
- Improper Maintenance and Cleaning: Products that have been improperly maintained or cleaned using harsh chemicals, abrasive cleaners, or methods not recommended by Zen Kitchens.
- Installed Products: This Warranty applies to the Products themselves and not to the cost of installation, removal, or re-installation.
- Countertops and Hardware (Material Specific): While this Warranty covers defects in workmanship for countertops and hardware manufactured by or for Zen Kitchens, material-specific warranties for quartz or other countertop materials are provided by the respective material manufacturers and are separate from this Limited Lifetime Warranty.
6.3 Warranty Period:
The Warranty period for the Products begins on the date of original purchase by the original purchaser, whether purchased directly by you or by a third party on your behalf (e.g., builder). This Warranty is valid only as long as the dwelling where the Products are installed is used as the original purchaser's primary or secondary home and does not extend to future owners if the property is sold or transferred.
6.4 Remedies:
In the event of a valid defect in workmanship or materials occurring during the Warranty period, Zen Kitchens will, at its sole option and discretion, take one of the following actions:
- Repair: Repair the defective Product or component, provided it is commercially feasible to do so.
- Replacement: Replace the defective Product or component with a new product or component of the same or similar style and quality, based on current product offerings and availability.
- Credit: If repair or replacement is not commercially feasible, Zen Kitchens reserves the right to provide a credit to the original purchaser towards the purchase of a similar type of product currently sold by Zen Kitchens. The credit amount will be determined by Zen Kitchens based on the original purchase price and the nature of the defect.
These remedies (repair, replacement, or credit) are the sole and exclusive remedies available to the original purchaser under this Warranty for any defects in the Products.
6.5 Limitations and Exclusions:
- Limited to Product Replacement: This Warranty is limited to the repair or replacement of defective Products or components only. It does not include any costs for service, labor, or transportation charges related to the removal, disassembly, or installation of the defective or replacement parts.
- Exclusion of Accessory Products: This Warranty does not apply to any products used in conjunction with the Zen Kitchens Products, such as countertops (material warranties are separate), appliances, plumbing fixtures, decorative hardware (finish warranties may be limited), lighting, or other accessories not manufactured by or for Zen Kitchens.
- Product Changes and Discontinuation: Repair or replacement remedies offered under this Warranty are subject to the current product offerings of styles and construction of Zen Kitchens at the time of the warranty claim. If a warranty claim is filed after a Product has been discontinued or become obsolete, Zen Kitchens reserves the right to replace the defective part with a part of the same or similar style and quality based on availability and cannot guarantee an exact match in style, finish, or color.
6.6 Sole Remedy and Limitation of Liability:
The remedies described in section 6.4 are the sole and exclusive remedies, and Zen Kitchens' entire liability for any breach of this Warranty. Under no circumstances shall Zen Kitchens' total liability under this Warranty exceed the actual amount paid by the original purchaser for the defective Product.
Zen Kitchens shall not be liable for any consequential, incidental, special, indirect, or punitive damages arising out of or related to the Products or this Warranty, to the maximum extent permitted by applicable law.
6.7 State Law Rights:
This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
6.8 Warranty Claim Procedure:
To make a claim under this Limited Lifetime Warranty, please follow these procedures:
- Contact Zen Kitchens or Authorized Dealer: Contact Zen Kitchens directly at info@zenkitchensrta.com or (866) 936-6965 or contact the authorized Zen Kitchens dealer from whom you purchased the Products.
- Provide Proof of Purchase: You must provide a dated sales receipt or other valid proof of original purchase to demonstrate warranty eligibility.
- Describe the Defect: Clearly describe the nature of the defect in materials or workmanship and provide photographs or other documentation as reasonably requested to support your claim.
